On Monday October 9-2017, Kubinda Sahota had spoken with the first mortgage holder informing him that financing was guaranteed and was forthcoming.

On Thursday October 12-2017, I was locked out of my building.

Friday October 6-2017  -  Yesterday my cell phone was not with me at the time.  I saw that nearly an hour earlier I had been asked to accept a video cell phone call.  Later; upon thinking about it, I sent Ramona a text informing her that I would not accept a video cell phone call for safety and security reasons.

During the hours that follow; I discussed my concerns with other people and business people as to why I had declined accepting a video call.  The fact is that both Kubinda Sahota and Ramona (647) 625-6451 know that; if I report my chronicles of events that occurred with both Kubinda Sahota and Ramona (647) 625-6451, that they would lose their licenses if they have any but would definitely be charged with multiple counts of Fraud by the FSCO.  The FSCO had informed me of that information during two telephone calls.

I mentioned these details when I had discussed this with them.  Once they knew those facts, they ALL said not to accept any video cell phone calls.  They were concerned for my safety and well being also.

Wednesday September 27-2017  -  In early May, I had financing from another lender through my lawyer's partner and would not have become involved with Kubinda Sahota, if Kubinda Sahota had been honest from the very start.  I am a business owner of 25 years.  I am filing a complaint with the FSCO, and with the Ontario Real Estate Board.  My allegations are for fraud as informed by the FSCO.  I am going to file two lawsuits against Kubinda Sahota.  One for compensatory damages and another for punitive damages.

Sunday October 1-2017  -  Weird~!  Unbelievable~!  Threatened with illegal activity~!  -  Kubinda Text - 3

I had sent a text to Ramona (647) 625-6451, and a copy of that text to Kubinda Sahota (647) 718-0929.  In a text message sent to both of them at 11:08am Sunday October 1-2017; I had told them both, that: "I Googled your phone numbers.  Very interesting search results on the first page."  The search query results found on the first page showed my webpage chronicling the information found on the 2 pages I posted.

Sunday evening; October 1-2017, Ramona (647) 625-6451 phoned me, and Kubinda Sahota (647) 718-0929 began to text me.  Both of them know that I will be signing over my property this week to the first mortgage holder, because the 100 percent guaranteed financing stated on numerous different occasions since early May was bull shit and that during this time, "Power of Sale" had occurred and the 20 days given for me to dispute it or pay off the first mortgage had passed by approximately 2 weeks.

During that call; Ramona stated that it was not professional of me to post a webpage.  During one of her few phone calls; Ramona asked my why I don't go back to the financing agent from early May 2017.  That financing offer vanished when I decided to go with the 100 percent guaranteed financing from Kubinda Sahota.

Kubinda send me a few text messages during this same time.  She told me; "She did not have my information".  Since early May 2017, she allegedly had secured financing on my commercial property numerous times.

Ramona (647) 625-6451 phoned me, and Kubinda Sahota (647) 718-0929 told me to remove my webpages that chronicle my experience with the two of them.  I replied in text the following message to both of them.  The webpage is offline and you will as agreed send myself and my lawyer Allan McCracken the Letter of Commitment tomorrow before noon.  If you live up to your promised Letter of Commitment then I will leave the webpage offline.  Do you agree?  Yes or No?

Neither of them answered.  Instead Ramona called me a few times and Kubinda began texting me.

Kubinda Text - 1  -  Ramona is working on your commitment. Each time you play this game she refuses to handle your file.  If you want her to successfully complete your financing then stop these games.

My text  -  1  -  Tomorrow before noon.

Kubinda Text - 2  -  I am not working on your file Ramona is.

My text  -  2  -  By noon regardless.

Kubinda Text - 3  -  If I want my IT guy will delete the page each and every time your post.  Trying to be civil with you.  She is working on it but if you continue with there games you will receive nothing.

Kubinda Text - 4  -  She is dealing with many lender's it's not an easy deal yo finance bc of the MLS listing.  Have faith in Ramona she will deliver but not by putting a gun to her head.

My Text - 3  -  You two are playing games with my business and my life.  By noon tomorrow.  The only person that can remove a website or webpage is the government or its creator.  I know the internet and the FSCO laws.  Provide Ramona with the information she needs.  I've got broken ribe and have been moving equipment since 5am and I'm going to bed.  Noon tomorrow.

Read Email - Saturday September 30-2017 to see the Letter of Commitment promised by Ramona (647) 625-6451 that day.

Nearing the end of the months of dealing with Kubinda Sahota and Ramona; I was informed by Kubinda, that I would owe $30,000.00 additional fees for two "appraisal underwriters", as she called them, plus her commission fees.  Is it possible two so called appraisal underwriters might have been Kubinda Sahota herself and Ramona; or; Kubinda and her husband or a family member?

Question:  If you knew you had committed fraud and could be charged by the FSCO for committing fraud;  would you risk your licenses, your livelihood, your reputation, your home, your cottage, the homes of your family members, and more;  OR... would you admit your wrong doing and do everything in possible to right the wrongs that led to those circumstances ?

Tuesday September 26-2017 - The Government of Ontario FSCO stated changing a commercial appraisal value is FRAUD, and further stated, that all digital information can be found on any device, online, or on the cloud.

To the reader:

The reason for this page's existence is because I had secured financing through my lawyer's partner's lender, but was persuaded that the 100 percent guaranteed financing through Kubinda Sahota and Ramona was the better guaranteed financing package.  The 100 percent guaranteed financing through Kubinda Sahota and Ramona has never materialized.  Because of this; my company was unable to profit from a, "Summer Santa Sale", was unable to build up finished good stock, and unable to sign a Vendor/Supplier Agreement estimated to be worth $1,800,000.00 per year.

I write this with a heavy heart.  It is my belief there is a grave danger to business and its future in Canada.

This web page will host articles of law, many email, text messages, and excerpts from telephone conversations.  I am not the law, nor am I a lawyer; so I pass no judgment.  The facts seen here are fact; chronicling my experience with financing, and the persons contained herein.

Subject:  FSCO + OREA + RECO - Tuesday October 17-2017

 

Today being Tuesday October 17-2017.

Kubinda Sahota and Ramona; you both informed me that it was completely legal and acceptable for either of you, or for you both, to change an official property appraisal from $400,000.00 to $650,000.00.  You stated that it was acceptable because you had not charged me for your services.

The FSCO - Financial Services of Ontario and the Ontario Real Estate Association and the RECO -Real Estate Council of Ontario all have informed me that it is illegal.

Because you both still insist that it is legal and acceptable within the real estate and financing sects of industry; and that you have done nothing wrong, to cause me the loss of my property and the financing thereof;  I have decided to poll your peers, being the 10's of thousands in the financial and real estate sect of industry to obtain their collective expert opinions on the matter.
 

The good news for you Kubinda Sahota and for you Ramona; is that I will remove your webpages, if and only if, the collective results of polling to the 10's of thousands in the financial and real estate sect of industry inform me that, what you both have done is legal.

Today; I will be arranging my final meeting with my real estate lawyer to sign over the property to Ralph Moulton.  You both remember Ralph Moulton.  Ralph is the first mortgage holder whom Kubinda contacted yet once again, on Monday October 9-2017 to inform him that you had financing.

As well; should the poll of the 10's of thousands return a collective response that changing an appraisal is illegal; then I will forward all the information including the companies and agents names that I poll over to The FSCO - Financial Services of Ontario and the Ontario Real Estate Association and the RECO -Real Estate Council of Ontario; as I do not know if any or all of the companies on your webpages are involved or as to the extent of their involvement and acceptance of your changing an official appraisal.

Hi Kubinda. You contacted Ralph Moulton on Monday October 9th informing Ralph that you and/or Ramona had financing from a lender.
I'm not threatening you Kubinda, I am simply turning the appraisal fraud issue over to the authorities later this week after I poll some of the companies on your webpages to get their collective opinions and the opinions of some of the 10's of thousands who are experts working in the financial and real estate sects of those industries.
If I'm wrong then that's the end of it and your webpages will vanish.
If their collective opinions validate the point of view of the FSCO and the OREA and the RECO, then those government offices will deal with things from thereafter.

Initially I was stressed thinking what the hell you are doing then I realized you are using this as  motive to speed dial financing. I don't have the contact for a 3rd mortgage it's Ramona. Kubinda you even stated that the property appraisal that you presented to Granville Cadogan was rejected by him on behalf of his lender, as he himself stated that the appraisal you presented was false and inflated.

In Summary:

Kubinda Sahota now implies that there are no copies of the fraudulent inflated appraisal proving that they changed the appraisal from $400,000.00 to $650,000.00.

Everyone knows that paper trails exist and are as easily traceable.  As well, deleted files are never truly deleted regardless of what software is used.  The  permanent digital footprints they leave behind are always traceable.

It is a wild guess on my part but I believe that Kubinda Sahota has already destroyed any paper copies of that fraudulent appraisal.

However; evidence of the fraudulent inflated documents still exist elsewhere and their existence can be proven.

From the text exchange above; it does appear that at least one of the companies named within these documents knows of the existence of the fraudulent inflated appraisal.

Hi Kubinda,

It is with deep regret; that I write this to you.  Please forward a copy to Ramona.

 

I believe what I was told by an FSCO staff.

The FSCO staff's first statement was: "These people are guilty of fraud and need to be thrown in jail.

The FSCO staff stated that: "my offer of an alternative option allowing you to redeem yourselves was far more than fare, and, that I did not have to offer any means of redemption as; in his opinion; you both had committed multiple counts of fraud".

The FSCO staff then stated that; "The court will have no problem finding you both guilty".

You both have exhausted my own ability to change things.  Things are EXACTLY as they were in early May, when you convinced me to turn down guaranteed financing through my lawyer's partner's lender, for your 100 guaranteed financing plus your promises of obtaining on my behalf, future government funding for Canadian exporters, through your knowledge and past experience with Export Canada.

I deliberately left you and Ramona your freedom of choice; and I respect your decision using your freedom of choice.

My only option and my freedom of choice; is to turn this matter over to the FSCO to investigate.  The FSCO will present its findings to the court for its determination.  Pending the court decision; my lawyers may begin a compensatory lawsuit, and a punitive damages lawsuit.

So: commencing Monday, September 25-2017 at 5:00pm; I will begin to populate the web page in the link below.  This web page will be forwarded to the FSCO, the RCMP, Homelife Liberty Realty Inc, MPire Realty Group Inc, Sunmicro Financial Inc, Granville-Cadogan General Law Practice, and as well to numerous other organizations and individuals.

I woke this morning before 4:00am as I have seldom been able to sleep since early May after the first 100 percent promised and guaranteed financing was never produced by yourself Kubinda, nor by Ramona.

Things went from a bad situation to a far worse situation; during the months I've known you both.

My bank became drained.  My property insurance became due, bills added up, etc etc.  Since early May; and throughout this time, both of you have sworn you had 100 percent guaranteed financing.  The latest promised financing was a "Letter or Commitment" that I was to receive yesterday, being Friday September 29-2017.

The evidence for all of this can be found online, or in email, or in text messages, or was provided during cell phone calls.  The last call I made to Ramona was made yesterday.  During that call Ramona's first concern was that my cell phone number was hidden.  But she talked briefly informing me that she will have that promised "Letter of Commitment" any moment.  That was at 46 second phone call at 3:50pm as evident on my cell phone.  Ramona informed me to turn on my caller ID next time.  She then informed me that she would be receiving the promised "Letter of Commitment" at any minute now.

I had my cell phone on speaker mode during the call I made that call to Ramona.   Two other people heard that conversation.  ( names available if needed for court ).

During the time since the beginning of May... plus I also mentioned my property insurance was soon to be delinquent if I did not make a payment.  That information neither of you knew.  Not yourself Kubinda Sahota; nor Ramona (647) 625-6451.   NOTE * * ( Ramona's last name is still being withheld from me )

I had received notice from my insurance broker informing me that my property insurance would expire Friday September 29th 2017 at midnight.  So I had written an email to my insurance broker stating the circumstances that I was facing with yourself and Ramona.  Being honest; I had also sent my insurance agent a link to your webpage in that email.  That is the same link that you had received Kubinda.  I had also spoken with my agent on the telephone and when asked of the circumstances, I again explained the details to my agent.    * NOTE *  The link to the webpage below... the webpage was purposely removed from public view and the time of removal is recorded on the host server in California USA.  It was removed from public view on my website because Ramona had informed me she had a "Letter of Commitment" and I did not want any lender to withdraw financing based on the information contained within that webpage.  That webpage can be uploaded and/or updated at any time and would include this email.

Yesterday; the insurance was paid by someone else using their debit card.  That fact is recorded in the bank.  That person agreed to use their card to pay my property insurance as that person was one of the two individuals that overheard the cell phone call with Ramona.  Ramona had stated the she would receive the "Letter of Commitment" any minute, and that I would have it today, which was Friday September 29-2017.

SO... the insurance company knows all the legal facts.  The two people that overheard the cell phone conversation at 3:50pm yesterday knows all the legal facts.  And the payment by one of the people who heard the cell phone conversation knows all the legal facts.

Today I am going to remove the remainder of my property from 200 McGuire Street which effectively has closed my business.

Kubinda; you and Ramona only have hours to act on how this all turns out.

I did give you both an option to redeem yourselves and prevent an FSCO investigation and subsequent multiple fraud charges from occurring.

So as you can see Kubinda Sahota, Ramona and yourself are truly in one heck of a legal mess if it goes that way.

Please forward this email to Ramona.  Perhaps Ramona should ask her lawyer immediately for his advice?  I think she would be find the recommendation from her lawyer is different from her own opinion.

Also inform Ramona that the FSCO is not worried that Ramona has a lawyer.    I believe the FSCO do expect her to have a lawyer present should the FSCO investigation finds that the facts are the facts; PLUS; knowing that records of these facts exist within other organizations such as my insurance company and receipts to substantiate the payment of insurance by a third party based on Ramona's statement that the "Letter of Commitment" would arrive yesterday.  Please see that Ramona receives a copy of this email immediately.  Thank you.

I have not formally filed a written complaint with the FSCO as of the writing of this email; however; that is the only option I have once the property title has changed hands.

I personally thought that the pair of you are smart enough to redeem yourselves.  I think that paying the existing Ralph Moulton mortgage down and bringing the taxes up to date and securing a new first mortgage might be your only way out of the mess you two created.  But that is just my opinion.  You both are the experts in this and have your own freedom of choice in your respective lives.  I know little about financing nor the laws governing various real estate and financing agents.

My time has all but ran out and I have to empty the property.

Today is the only day we can change our lives.  Making the right decision at the right time is imperative.

You Kubinda and Ramona are professionals in real estate and financing.  I am not.  I am ignorant of the legal processes and time frame and parameters of these legal processes.

However; that though it may be; leads me to have a question.

That question is at the bottom:

The first mortgage holder went to court for a "Power of Sale Court Order", and obtained that court order.

That court order offers 20 days to dispute the "Power of Sale Court Order".

Those 20 days to dispute the "Power of Sale Court Order", have passed and now exceeded by nearly 2 weeks.

The existing first mortgage holder is owed approximately $320,000.00.

The existing first mortgage holder is knows that offers up to $430,000.00 had been made on the property.

Legally; the existing first mortgage holder is legally able to assume property title.

Legally; existing first mortgage holder is able to sell the building to recoup his money.

SO...

Here is my question to you Kubinda Sahota and Ramona (647) 625-6451,  NOTE * * ( Ramona's last name is still being withheld from me ).

Would either of you accept an offer to get your money back via Ramona's promised yesterday, "Letter of Commitment";  OR;  would you refuse Ramona's promised yesterday, "Letter of Commitment"?

Like I said; I am ignorant of all the knowledge that you Kubinda Sahota and Ramona (647) 625-6451,  NOTE * * ( Ramona's last name is still being withheld from me ), both know and posses with regards to the laws of Real Estate and Financing and the FSCO.

You both do not seem to be worried about the possible outcome of your jointly having committed FSCO Fraud.  If I were in your shoes I would have already have apologized profusely and done everything I could to guarantee financing was provided, even if I had to pay for it myself to avoid an FSCO court ordered outcome.

Alternative Option to FSCO Fraud alleged Fraud Charges offered to Kubinda Sahota and Ramona in August

Kubinda Sahota and Ramona were offered the following alternative option to redeem themselves and prevent an FSCO investigation and Fraud charges.

 
The original commercial appraisal conducted by MPire Realty appraiser valued the property at $400,000.00.  I was informed by Kubinda Sahota herself that she had it changed to reflect a false value of $650,000.00.
 
They were offered to voluntarily contribute $40,000.00 each towards the financing deal which they had screwed up.
 
Their voluntary contributions would pay down the existing first mortgage and bring the property taxes up to date.  This should be more than enough for them to acquire a first mortgage as they had informed me they had already achieved; as stated many times since May.
 
The new required first mortgage would then require approximately $60,000.00 less which would enable them to secure and produce a new first mortgage which they promised me had been 100 guaranteed many many times since May.  Since the beginning of May, Kubinda Sahota and Ramona had stated numerous times, that funds had been secured and that financing was 100 percent guaranteed.
 
During this time, real estate agents brought buyers to my property.  Kubinda Sahota instructed me not to sell my property, stating: "the financing documents will be signed and conclude on Monday and that it would all be behind us Tuesday."
 
Furthermore; Kubinda Sahota and Ramona were offered 5 percent of my company sales to be split between them.  The reason being that; Kubinda Sahota and Ramona became aware that, True Value Stores USA, offered my company a Vendor/Supplier Agreement assessed at $1,800,000.00 annually.  Kubinda Sahota had stated and promised to secure further future government funding that would secure this and other Vendor/Supplier Agreements.  That is why the 5 percent of my sales was offered.  According to other financial agents, the return on the 5 percent could be worth an approximate $90,000.00 per year.
 
The True Value Stores USA agreement could not be signed until Kubinda Sahota and Ramona produced the signed financing documents that Kubinda Sahota and Ramona had stated were 100 percent guaranteed.
 
Deadline: Kubinda Sahota and Ramona were given a deadline date of today; September - 25-2017 5:00pm to produce their financing agreement to myself and to my lawyer; Allan McCracken, for signing, or; to have this webpage forwarded to the FSCO and the parties named herein commencing today at 5:00pm.
 
Neither Kubinda Sahota nor Ramona have addressed the issues of alleged FSCO Fraud.  Kubinda stated in a telephone conversation that these allegations hold no merit as Kubinda Sahota nor Ramona had been paid.  Kubinda Sahota further stated, that I personally do not have a copy of the altered commercial appraisal.

Question:

Is it legal to change a certified commercial appraisers appraisal from $400,000.00 to $650,000.00 ?  Kubinda Sahota CPA CGA & Realty Agent and Broker thinks it is legal.  BUT; I spoke with other mortgage agents including: Laurent Charbonneau, AMP, of INVIS - Canada's Mortgage Experts, and was informed and assured that it is illegal.  Later Kubinda Sahota stated that there was no money exchanged so it doesn't matter.  Later yet again; Kubinda Sahota told me to shut up in a text, then told me that I did not have proof that an altered copy existed.  Currently; I am awaiting a copy and/or verification of that copy's existence.  This will be updated once I have confirmation of the altered appraisal or a copy thereof.

Please note: I first began to obtain financing through Kubinda Sahota and Ramona (647) 625-6451 - (last name withheld from myself), in early May of 2017.  During this time; I discovered that information was allegedly changed to deliberately reflect a higher value on the commercial appraisal I paid to have conducted on my property.  It allegedly changed from $400,000.00 to $650,000.00.

After speaking this week with several individuals as well as a government agent or employee of The FSCO; Financial Services Commission of Ontario; I was informed that it was absolutely illegal and was fraud.  The FSCO; Financial Services Commission of Ontario stated clearly that the Act is the law.  He went on to state that should the FSCO become involved; that it could mean multiple fraud charges against the parties named herein and possibly others who were involved, plus the possible seizure of personal property, such as computers, cell phones, tablets, etc, which may also include the possible seizure of property or properties believed to have been obtained in whole or in part by criminal activities, plus the possibility of jail time.

Being that I require financing; I offered to Kubinda Sahota and Ramona (647) 625-6451 - (last name withheld from myself), an alternative option to their possibly being charged with fraud.  The option was for both of the parties named herein; to voluntarily put forth $40,000.00 of their own money towards the existing first mortgage so that they were able to secure the first mortgage funding they had repeatedly stated was 100 percent guaranteed on multiple occasions.  In lieu of this; I offered 5 percent of my sales to be split between them.  During the time that I have been dealing with Kubinda Sahota and Ramona (647) 625-6451 - (last name withheld from myself); a contract was offered by True Value Stores USA to become a vendor/suppliers to its 4,300 retailers.  The contract was estimated to be worth $1.800,000.00 per year by other financial agencies.

The option would allow for both of these parties to maintain their livelihoods as they currently know it to be.  Neither have accepted the alternative which the FSCO agent stated was more than generous.
